AI in Insurance: Balancing Efficiency and Ethical Responsibility

The integration of artificial intelligence into healthcare has transformed many aspects of patient care and administrative workflows. AI-driven tools are increasingly used for clinical documentation, patient monitoring, and even medical decision-making. However, recent legal challenges highlight a growing concern: when AI is used to make insurance coverage decisions, is it helping or harming patients? 

A lawsuit against UnitedHealth Group (UHG), UnitedHealthcare, and its subsidiary, naviHealth, raises critical ethical and legal questions about AI’s role in insurance claims processing. The plaintiffs allege that AI-driven claim denials led to adverse health outcomes, sparking debate about the balance between efficiency and patient rights. 

AI in Coverage Decisions: A Controversial Application 

The core of the lawsuit against UHG centers on the alleged use of an AI program, nH Predict, to determine post-acute care coverage under Medicare Advantage plans. Plaintiffs argue that instead of relying on medical professionals, the algorithm was used to assess claims, resulting in inappropriate denials of coverage. 

According to the lawsuit, nH Predict’s determinations often superseded physician recommendations, allegedly leading to denials that were later overturned in 90% of appeals. Such a high reversal rate raises questions about the reliability of AI in making these critical healthcare decisions. Plaintiffs claim that premature discharges due to AI-driven denials contributed to worsened health conditions and, in some cases, patient deaths. 

UnitedHealth has denied these claims, stating that nH Predict is not used to make coverage decisions but rather serves as a guide for care planning. The company asserts that all final determinations align with plan policies and guidelines established by the Centers for Medicare & Medicaid Services (CMS). However, the persistence of such lawsuits underscores a broader industry issue: how AI should be ethically and effectively implemented in healthcare insurance. 

Legal and Ethical Challenges in AI-Driven Insurance 

A federal judge recently dismissed five out of seven counts in the class-action suit against UnitedHealth, but two key allegations remain: breach of contract and breach of the implied covenant of good faith and fair dealing. These claims suggest that AI-driven denials may have violated UnitedHealthcare’s obligation to provide medically necessary coverage as stipulated in its policies. 

The lawsuit is not an isolated incident. Similar allegations have been made against other major insurers, including Cigna and Humana. Cigna faced accusations of using an algorithm, PXDX, to systematically deny payments for treatments that did not match specific preset criteria. Meanwhile, Humana was accused of using AI-based tools, including nH Predict, to cut payments prematurely for rehabilitative care. 

These cases highlight a fundamental concern: If AI is leveraged primarily as a cost-saving measure rather than a tool to enhance patient care, insurers risk crossing ethical lines. The healthcare industry must address these concerns to prevent AI from being perceived as a mechanism for systemic denial of necessary treatments. 

Balancing AI’s Potential with Patient Protection 

AI has demonstrated immense potential in streamlining administrative processes, improving workflow efficiency, and even assisting in medical decision-making. However, when deployed in insurance claims processing, it must be used responsibly to ensure patient well-being is not compromised. 

Transparency and Accountability: One of the primary concerns is the opacity of AI-driven decision-making. Many insurers use proprietary algorithms, making it difficult for patients and providers to understand how coverage determinations are made. Greater transparency is needed to ensure that AI recommendations align with clinical best practices and regulatory standards. 

Clinical Oversight: AI should not replace human medical judgment but rather augment it. Healthcare professionals must remain at the center of coverage decisions, with AI serving as a tool rather than the final arbiter. Implementing safeguards, such as mandatory human review of AI-generated denials, could help mitigate potential harm. 

Regulatory Compliance: Stronger regulatory oversight is necessary to prevent AI from being misused in ways that prioritize cost-cutting over patient care. CMS and other governing bodies may need to develop clearer guidelines for the use of AI in coverage determinations to ensure ethical and fair implementation. 

The controversy surrounding AI-driven insurance denials is unlikely to disappear anytime soon. As insurers continue to adopt AI, they must strike a balance between operational efficiency and ethical responsibility. 

The ongoing legal battles serve as a wake-up call for the industry: AI’s role in healthcare should be to support, not hinder, patient access to necessary care. Insurers that use AI responsibly—ensuring transparency, oversight, and patient-centric policies—will ultimately build trust and set the standard for ethical AI implementation in healthcare. 

The future of AI in healthcare is not just about automation; it’s about ensuring that technology serves the best interests of patients and providers. The industry must work together to create AI-driven systems that enhance, rather than diminish, access to quality care.
