The Due Date for Federal Public Health Emergency is May 11, 2023


At the beginning of February, President Biden made an announcement from which it became clear that the Federal Public Health Emergency Declaration (PHE) ends May 11, 2023. 

The key points you need to remember: 

Ryan Haight Act 

If the DEA does not take some regulatory actions, you will need to have at least one prior in-person visit with the patient to whom you are prescribing a controlled substance through telemedicine starting May 11, 2023. 

We want to underline that it applies only to new patients who have never before been in person. That is why you should invite patients under this category to your appointments between now and May 11.
